Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Tradework Labs ("we", "us", or "our"), including our customer operations platform for trade businesses, AI voice and chat bots, marketing automation, and related websites (together, the "Services"). By using the Services, you agree to be bound by these Terms.

The Services

The Services are intended for use by trade businesses to manage customer records, operate AI voice and chat bots, automate follow-ups, and run marketing campaigns. We may change, add, or remove features from time to time to improve the Services.

Accounts

To use the Services, you must create an account. You agree to provide accurate information, keep your credentials secure, and promptly notify us of any unauthorized access. You are responsible for all activity that occurs under your account.

Acceptable use

You agree to use the Services only for lawful purposes and in line with these Terms. You will not:

• Use the Services to send unsolicited communications in violation of applicable law.
• Upload content that is illegal, infringing, defamatory, or harmful.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.
• Use the Services to impersonate another person or misrepresent your identity.
• Use our AI features in ways that violate any applicable laws or third-party rights.

Fees and billing

If you subscribe to a paid plan, you agree to pay the applicable fees shown at signup. Fees are billed in advance on a recurring basis and are non-refundable except where required by law. We may change our fees, and will give you reasonable notice before any change takes effect. Failure to pay may result in suspension or termination of your account.

Your content and customer data

You retain ownership of the content and customer data you provide to the Services. You grant us a limited license to host, process, and transmit that content as necessary to provide the Services to you. You are responsible for obtaining any consents required from your customers for call recording, text messaging, or other communications that pass through the Services.

Intellectual property

The Services, including all software, design, and content we provide, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights in the Services.

Third-party services

The Services may integrate with third-party tools and services. We are not responsible for the availability, accuracy, or practices of any third party, and your use of those services is governed by their own terms.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of or related to these Terms or the Services will not exceed the amount you paid us in the twelve months preceding the claim.

Termination

You may cancel your account at any time. We may suspend or terminate your access to the Services if you violate these Terms, fail to pay, or if we are required to do so by law. On termination, your right to use the Services ends; provisions of these Terms that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will let you know by updating the date at the top of this page and, where appropriate, by providing a more prominent notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to its conflict of law rules. Any disputes will be resolved exclusively in the courts of that jurisdiction, unless otherwise required by applicable law.
